Yusril Comments On Prabowo's Statement Regarding Forgiveness For Corrupt Individuals As A Strategy For Asset Recovery

The Coordinating Minister for Law, Human Rights, Immigration, and Corrections, Yusril Ihza Mahendra, stated that President of the Republic of Indonesia, Prabowo Subianto's declaration to forgive corrupt individuals who return stolen funds to the state is part of a strategy for recovering state losses, known as asset recovery. Yusril noted that this approach aligns with the United Nations Convention Against Corruption (UNCAC), which Indonesia has ratified.  

"What the President articulated is consistent with the provisions of the UN Convention Against Corruption (UNCAC) that we ratified through Law No. 7 of 2006. In fact, one year after ratification, we were obligated to align our Anti-Corruption Law with the convention, but we have delayed fulfilling this obligation and are only now seeking to do so," Yusril explained in a written statement on Thursday, December 19, 2024. " 

The emphasis on anti-corruption efforts, as per the convention's regulations, is on prevention, effective eradication of corruption, and recovery of state losses (asset recovery)," he added. 

Yusril further indicated that President Prabowo's statement reflects a shift in the philosophy of punishment within the application of the National Criminal Code, which is set to be implemented at the beginning of 2026. "Punishment will no longer focus on revenge and deterrence for offenders, but rather on corrective, restorative, and rehabilitative justice. Law enforcement in corruption offenses must yield benefits and contribute to the economic improvement of the nation and state, rather than solely emphasizing punishment for the perpetrators," he remarked.  

Yusril also emphasized that if the assets obtained through corruption remain with the corrupt individuals without being returned to the state, they will not contribute to economic development. Conversely, he stated that if the proceeds of corruption are returned to the state budget, it could aid in improving the welfare of the people.
